Last fall (2011) I did Blue Lotus' shows in Georgetown and San Antonio. I contacted the taxing authority for my sales taxe license, paid them and got my license - no problem. A week or so later I get another bunch of paper work requiring me to apply for a Franchise License. I did it and got a letter back that a Franchise License would not be required. Within a week after I got home to Colorado I paid my sales taxes- but not the end of the story. This spring I get a threatening letter from Texas that I had not paid my Franchise Taxes or closed my Franchise Tax account. I sent them a rude reply and got another letter that my case was being "reviewed". My art business is a subS corporation which is all I can figure out what triggered this for 5 days of doing business in Texas. I have sent emails to Blue Lotus but she has not replied. Needles to say I will never go back to Texas for another show. Anyone have similar experience or explanation? I am expecting another letter any day now.
Just to reiterate the problem, TCPA told me I did not need a Franchise License for 5 days of art show business in TX. 7 months after the fact, they now wan to know why I haven't paid my franchise tax or closed my franchise tax account. Idiots, I never was issued a franchise tax account by your decision. Too many bureacrats without enough real work to do.
When we were approached by a live Texas tax agent, we were glad to have actual contact with a human. He gladly gave us his card and told us to get in touch if we had any problems. We did. He was very helpful. We've had the same experience at other shows in other states.
When we're genuinely glad to see them as someone who can guide us through the process, they're happy to be on our side in case of a problem.
Yep, years ago I used to yell at tax people. It isn't always easy to control your inner chihuahua.
Don't mess with Texas Comptroller. They have started sending out their own staff to different craft festivals to verify in-situ that everyone selling actually has a state tax ID. And they will take your license away - makes no sense when Comptroller wants your tax dollars in the end....not you going out of business.
AZ is a different situation. My brother has a business in AZ and is always late but he doesn't get hassled.
Thanks,will do. Sounds like you have been there and done that. Had to call AZ because they moved a decimal point on my Tubac tax return and they sent me a refund of taxes check. I had to hang on hold for over 30 minutes to get a human voice. When I repaid them they wanted a late fee for their mistake. I told them what the could do with their late fee and heard no more.
Texas is absolutely the worst state for taxes and forms. We make gourmet caramel and chocolate sauces and had always done just one show in Texas. Now that we have a space in the wholesale mart as well, not only do we haVe to file quarterly, do the franchise thing, but we also have to file and property tax!
